Personal injury to mother and child in alleged DWI car accident

Drivers in Missouri who choose to operate their vehicles while they are under the influence of alcohol may not always consider the consequences of their actions. Regardless of the legal implications of DWI, car accidents could cause havoc in the lives of other road users and their families. A 24-year-old man was recently arrested after allegedly causing an accident that resulted in severe personal injury to a young mother.

Sullivan Police reported receiving a call about an accident just before midday on a recent Sunday. The accident report states that a male driver was traveling east when he allegedly crossed over into the westbound traffic lanes and crashed into a vehicle occupied by a 22-year-old mother and her toddler. The impact reportedly caused the mother to be trapped, and the situation required emergency workers to extricate her. She was airlifted to a medical center, and her condition was reported to be serious, while her young son was treated for minor injuries at a different hospital.

Police reported that blood alcohol tests revealed that the driver who allegedly caused the accident was intoxicated. The reported level of alcohol in his blood was .35 while the legal limit is .08. He was arrested and held in jail on bond of $50,000. The driver will now be facing DWI charges, along with a second-degree vehicular assault charge.

Missouri residents who have suffered personal injury in a car accident caused by the negligence of another party may want to pursue recovery of expenses related to the incident. They retain the right to file a personal injury claim against the alleged negligent party in a civil court. If the claim is successfully presented, the court may award monetary compensation to cover medical expenses. Depending on the circumstances, the state laws may allow the court to award additional restitution to cover other damages.
