Alleged cement truck driver impairment causes death of motorist

A popular Branson resident lost his life in a tragic accident on a recent Wednesday. According to an accident report, truck driver impairment allegedly led to the crash on Missouri 76. The man who died in this accident was 34 years old and worked as a server in several local restaurants.

The Missouri State Highway Patrol reported that a 56-year-old man who was operating a cement truck was eastbound on Missouri 76. He allegedly failed to maintain control of the heavy vehicle as he went through a curve. Reportedly, the vehicle crossed into the westbound traffic lanes where it smashed head-on into an SUV. Upon arrival, emergency workers found the cement truck on its side along with the severely damaged SUV.

The report indicates that the crash occurred shortly after 10:30 a.m. and the SUV driver died at the accident scene. He was declared dead at approximately 11 a.m. Officers booked the cement truck driver for felony driving while impaired, and he was released for treatment of minor injuries.

The man who lost his life in this accident was from another country, though his surviving family members are still entitled to file a wrongful death lawsuit. The family may choose to retain the services of an experienced Missouri personal injury attorney to navigate the claim for them. Authorities allege this death resulted from truck driver impairment and proving such negligence may lead to a successful claim against the driver and his employer. Once financial liability is established, the court can adjudicate documented claims for financial losses to include in a monetary judgment. The claims may include out-of-pocket monetary losses and emotional damages sustained.
